ELIGIBILITY: OPEN ONLY TO ADULT RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA. To be eligible to enter and win, each entrant must be a legal resident of the fifty United States or the District of Columbia, 18 years of age or older and logging onto the Internet in the United States. Employees of A&E Television Networks ("Sponsor"), GEM Group, Inc. ("Administrator"), and each of their respective parents, affiliates and subsidiaries and each of their respective officers, directors, employees and members of the immediate family and persons living in the same household of each are ineligible.
PRIZES: One (1) Grand Prize shall be awarded. The Grand Prize will consist of: a $500 A&E Gift Certificate, redeemable at www.ShopAETV.com or www.ShopHISTORYCHANNEL.com. (Actual Retail Value ("ARV") of Grand Prize: $500). No prize substitutions or cash redemptions allowed. Sponsor reserves the right to substitute prizes of equal or greater value in the event that a prize becomes unavailable for any reason. Grand Prize will be awarded. Any items not specifically described in these Official Rules, including, but not limited to, taxes, insurance, installation expenses (except where expressly described), service fees and all expenses for any of the foregoing are the sole responsibility of the Winner.
HOW TO ENTER AND WIN: Limit one entry per person, household and/or email address per day. Entries received between 12:00:01 PM (ET) on May 7, 2007 and 11:59:59 AM (ET) on June 1, 2007 shall be eligible for the sweepstakes drawing. Eligible entrants may enter the sweepstakes by visiting http://www.history.com/sweepstakes/serenity, completing the entry form, including first name, last name, email address, street address, city, state, ZIP code, country and date of birth and clicking the "submit" button to complete the entry process. All complete eligible entries will be entered in the sweepstakes. Submission of an incomplete entry may result in disqualification. Entries become the property of Sponsor and will not be returned. Sponsor shall not be responsible for incorrect or inaccurate transfer of entry information, human error, technical malfunctions, lost/delayed data and/or digital transmissions, omission, interruption, deletion, defect, or any other problem or error that may occur, resulting in late, lost, incomplete or misdirected entries. Sponsor shall not be responsible for lost or misdirected messages, unavailable network connections, failed, incomplete, garbled or delayed computer transmissions, online failures, hardware, software or other technical malfunctions or disturbances or other communications failures or circumstances affecting receipt of entries or entrants' ability to participate in this promotion. By entering, each participant agrees to be bound by the official rules and regulations of this promotion. Winner will be selected at random from a pool of eligible entrants. The random drawing will be conducted on or about June 8, 2007 by the Administrator, whose decisions shall be final. Odds of winning will depend upon the number of eligible entries received. Winner will be notified by phone and/or email at the phone number and/or email address provided on the entry form. The potential Grand Prize Winner will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release ("Release") except where prohibited by law. The completed and signed Affidavit and Release must be received by Sponsor within five (5) days of notification or prize will be forfeited and an alternate winner selected. Return of any prize notification as undeliverable will result in disqualification. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the email account is registered. Winner may be required to provide evidence that winner is the authorized account holder of the email address associated with the winning entry and complete an affidavit of eligibility, release of liability, and any applicable releases. All applicable federal, state and local laws and regulations apply. Winner is responsible for all federal, state and local taxes. An IRS 1099 tax form will be issued to Winners of prizes valued at $600 or more. Sweepstakes is governed by the laws of the State of New York, with venue and jurisdiction in New York County, NY and all claims must be resolved in the courts located in New York County, NY. By entering, entrants/winners agree: (1) to release the Sponsor and Administrator and their agents, employees, officers and affiliates ("Releasees") from any and all claims, injuries, liability, losses or damages of any kind, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize, or product purchased with the prize, or participation in this Sweepstakes; (2) to be bound by the Official Rules; (3) that the decisions of the Sponsor or Administrator are final and binding on all matters relating to the Sweepstakes; (4) to the use of their names and likenesses for advertising and promotional purposes solely in connection with this promotion, in all media worldwide (including online) without additional compensation, except in TN and where otherwise prohibited by law; (5) that the prize and any product purchased with the prize is AS IS and WITHOUT WARRANTY OF ANY KIND, express or implied, (including without limitation any implied warranty of merchantability or fitness for a particular purpose) unless otherwise expressly granted by the prize manufacturer; and (6) that the Releasees are not responsible for any inability of any winner to accept or use any prize or product purchased with the prize (or portion thereof) for any reason.
USE OF ENTRANT INFORMATION: As permitted by law and in accordance with Sponsor's Privacy Policy, Sponsor may use information which all entrants provide about themselves to send them announcements about Sponsor's products and programs via electronic and ordinary mail. An entry, except where prohibited by law, constitutes a grant of permission to Sponsor or its agents to include winner's name on the www.HistoryChannel.com site and in connection with a Winner's List without further notice.
UNFORESEEN EVENTS: Sponsor, in its sole discretion, reserves the right to terminate this promotion at any time, including if Sponsor becomes aware of any occurrence which would materially affect the promotion's security or fairness, including but not limited to technical malfunction of the www.HistoryChannel.com site, software and/or hardware transmission failures, and virus contamination.
